Background — SONA 2026 Focus on Enforcement and Jobs

During SONA 2026, President Ramaphosa reaffirmed the government’s commitment to strengthening enforcement of labour and immigration laws to protect workers and improve compliance in workplaces nationwide. A key component of this commitment was the announcement of 10 000 additional permanent labour inspector posts to be created in 2026.

The intention behind this expansion is to bolster the Department’s capacity to enforce compliance with labour legislation, particularly in high-risk areas such as hiring of undocumented workers, minimum wage enforcement, and adherence to workplace standards.

Clarifying the Inspector Posts

The Department of Employment and Labour has emphasised that:

  • The 10 000 new labour inspector posts are permanent positions intended to strengthen enforcement capacity across the country.
  • These posts are separate and distinct from Project 20K, which is a fixed-term youth internship initiative that aims to place 20 000 inspector and enforcement interns over two years.

 

At present, South Africa has approximately 2 300 active labour inspectors, indicating a significant increase in resource capacity once these new posts are operational.

According to government statements following the SONA:

  • The expanded inspectorate will prioritise compliance related to immigration and labour law enforcement, especially where employers may be exploiting foreign nationals without valid work documentation.
  • The increased inspectorate is intended to improve enforcement of key statutes, including the Basic Conditions of Employment Act (BCEA), Labour Relations Act (LRA), Employment Equity Act (EEA) and Occupational Health and Safety (OHS) provisions.
  • The Department has signalled ongoing collaboration with the Departments of Home Affairs and the South African Police Service (SAPS) to ensure coordinated enforcement activity.

  • The current inspectorate is significantly understaffed relative to the number of workplaces in South Africa.
